AhaPower and its payment providers may carry out reasonable identity, transaction, address and fraud checks. We may request supporting information or decline a transaction where there are reasonable grounds to suspect fraud, unlawful activity or unauthorised payment.
Personal information used for these checks will be handled according to the Privacy Policy and applicable law.
9. Delivery
Delivery is governed by the Delivery and Returns Policy. AhaPower ordinarily uses The Courier Guy but may use another suitable provider.
Estimated delivery dates are not guarantees unless expressly agreed in writing. Batteries, inverters, generators, solar equipment and heavy or regulated goods may require special handling or an alternative service.
Unless another period is agreed, AhaPower will execute an online order within 30 days after receiving it as required by applicable law. An EFT order’s processing and delivery estimate begins only after cleared payment has been verified, unless AhaPower agrees otherwise.
10. Risk and ownership
Ownership of goods remains with AhaPower until full cleared payment has been received. Risk passes as determined by applicable law and the agreed delivery arrangement. Nothing in this clause transfers to a consumer a risk that the law requires AhaPower to carry.
11. Cancellations, returns and refunds
Cancellations, cooling-off rights, returns, transit damage, refunds and defective goods are governed by the Delivery and Returns Policy, the Consumer Protection Act, the Electronic Communications and Transactions Act and other applicable law.
Where section 44 of the Electronic Communications and Transactions Act applies, a consumer may cancel an online purchase without reason within seven days after receiving the goods, subject to the statutory conditions and exclusions.
A discretionary change-of-mind return outside a statutory right requires prior written approval and may be subject to reasonable return costs and lawful deductions described in the Delivery and Returns Policy.
12. Warranties and defective goods
Nothing in these terms excludes or reduces the implied warranty of quality or another right under the Consumer Protection Act.
Supervolt and Enertec batteries purchased from AhaPower carry a 30-month warranty from the date of delivery, subject to the relevant manufacturer’s warranty terms, operating specifications and lawful exclusions.
The battery warranty does not cover damage caused by incorrect installation, reverse polarity, incorrect charging voltage, overcharging, excessive discharge, short circuits, loose connections, incompatible equipment, physical damage, misuse, tampering or operation outside manufacturer specifications.
Returns and warranty claims normally take between two and four weeks to assess and finalise after receipt. This is an estimate and does not override a mandatory statutory remedy or deadline.
13. Installation and electrical safety
Electrical, solar and backup-power products must be selected, installed, commissioned and maintained according to manufacturer instructions, applicable standards and legal requirements. Work requiring a qualified or registered person must be performed by an appropriately qualified or registered person.
AhaPower may request photographs, system specifications, test results, a technician’s report, installation records or a certificate of compliance when assessing compatibility, safety or a warranty claim.
Unless AhaPower expressly agrees to provide installation, the sale of a product does not include installation, site assessment or certification.
14. Website use
You may use the website only for lawful personal or business purposes. You may not:
- Attempt to gain unauthorised access to the website, accounts, servers or data;
- Introduce malware, interfere with operation or circumvent security controls;
- Use automated tools to scrape, copy or overload the website without permission;
- Submit false, misleading, unlawful or infringing material;
- Impersonate another person or use an unauthorised payment method; or
- Use website content in a way that infringes AhaPower’s or another person’s rights.
AhaPower may restrict access where reasonably necessary to protect the website, customers or business, subject to applicable law.
15. Intellectual property
Website content, branding, layout, text, graphics, photographs, software and databases are owned by or licensed to AhaPower unless stated otherwise. Personal, non-commercial viewing and printing are permitted. Reproduction, republication, modification, scraping, distribution or commercial exploitation requires prior written permission.
16. Third-party services
The website may use or link to PayFast, The Courier Guy, banks, manufacturers, social-media platforms and other independent providers. Their services may be subject to separate terms and privacy policies.
AhaPower is not responsible for an independent provider’s website, systems or content, but remains responsible for its own obligations to the customer and for any liability that applicable law does not permit it to exclude.
17. Disclaimers and limitation of liability
AhaPower does not exclude liability for fraud, gross negligence or any loss, warranty, duty or consumer right that cannot lawfully be excluded or limited.
Subject to the preceding sentence and applicable law, AhaPower will not be liable for indirect or consequential loss that was not reasonably foreseeable when the agreement was concluded, or for loss caused solely by the customer’s misuse, unauthorised modification, incompatible equipment, incorrect installation or failure to follow instructions.
Website interruptions, third-party delays and circumstances outside AhaPower’s reasonable control will be addressed fairly and in accordance with applicable law. Nothing in these terms requires a consumer to waive a statutory remedy.
18. Events outside reasonable control
AhaPower will not be responsible for a delay or failure caused by an event outside its reasonable control, including severe weather, fire, flood, civil unrest, load shedding, network failure, labour disruption, transport interruption, supplier failure, regulatory restriction or similar event, provided that AhaPower takes reasonable steps to limit the effect and communicates material delays.
This clause does not remove a customer’s right to cancel or obtain another remedy where applicable law provides one.
19. Complaints and dispute resolution
Please send complaints to info@ahapower.co.za with the relevant order or invoice number and supporting information. AhaPower will investigate and attempt to resolve the matter fairly.
If a qualifying consumer complaint is not resolved directly, the customer may approach the Consumer Goods and Services Ombud or another competent regulator, ombud, tribunal or court.
20. Electronic communications and notices
You consent to receiving transaction-related communications electronically at the details you provide. Communications include quotation, order, payment, delivery, return, warranty and security messages.
An automated acknowledgement does not necessarily constitute acceptance of an order. Formal legal notices to AhaPower must be delivered to the confirmed address for service shown in the Legal Notice.
21. Governing law
These terms and transactions with AhaPower are governed by the laws of the Republic of South Africa. Subject to mandatory consumer rights and the jurisdiction of authorised ombuds or tribunals, South African courts will have jurisdiction.
22. Changes to these terms
AhaPower may update these terms prospectively when its services, payment methods, providers or legal obligations change. The terms applicable to an accepted order are generally those presented when the order was placed, unless a change is required by law or agreed with the customer.
23. General provisions
If part of these terms is unlawful or unenforceable, it will be treated as severed or limited to the minimum extent necessary, and the remaining provisions will continue to apply.
A failure or delay in enforcing a right is not a waiver. No change to an accepted order is binding unless agreed through an authorised AhaPower channel.
These terms, the accepted order or quotation and the incorporated policies constitute the agreement regarding the transaction, subject to any representation or right that applicable law requires to remain effective.
